Dawsons Music & Sound staff could be entitled to 90 days’ pay

Unfortunately, Dawsons Music & Sound Ltd staff went into administration on the 1st September. If the staff are at risk of redundancy, or were made redundant without any prior consultation, they could be entitled to a protective award.

What is a protective award?

If you are an employee of Dawsons Music & Sound and have been made redundant, or believe you are at risk of redundancy, you may be eligible for a protective award claim.

A protective award is an award of payment given to staff if their employer did not consult with them adequately prior to their redundancy. You are entitled to claim this award, as long as at least 20 other employees have been made redundant, or are about to be made redundant in your place of work.

Do not worry, a protective award claim is separate from the normal redundancy claim, such as holiday entitlement and outstanding wages. This means you can have two separate redundancy claims and two separate redundancy payouts.

How much will my protective award pay?

If you have not been consulted with adequately prior to your redundancy, you can receive the maximum award of 90 days’ gross pay, capped at a maximum of £544 per week.

In cases of administration, employees can still receive the maximum award. But, if not, the Government will guarantee 8 weeks’ pay to those under its Insolvency Service.

If you are eligible and want to pursue a claim, you must go through ACAS conciliation first before issuing your claim in the employment tribunal.

You must issue your claim 3 months less than a day from the date of dismissal.

You can represent yourself, however, it is strongly recommended that you seek expert advice. This is because there are various legal and procedural hurdles that need to be overcome. Claim Forms need to set out in a specific manner in order to maximise the chances of success.  The Tribunal may also issue orders and directions that will need to be complied with.
