Super Injunctions

There has been a great of publicity recently in the press on the question of Super Injunctions, as they are called by the tabloids. They first came to light a few years ago when Naomi Campbell brought a claim against the media for, effectively invasion of her privacy.

English law does not have any statutory code of privacy law. Historically therefore someone wishing to make a complaint has had to rely on the law of confidence, though it is fair to say that European legislation has provided some additional protection.

The current law has evolved very quickly and it appears likely that Parliament may enact in early course legislation seeking to offer more privacy laws for our citizens. In the meantime, any applications made must establish that the Defendant (usually the media) has come into possession of information which it must know, or reasonably be expected to know in confidence.
