Slips and trips

Falling over in public can be a rather embarrassing situation. However, it can also result in significant injury and financial losses, and in many circumstances you are entitled to be compensated for this.

If you have suffered an injury as a result of a trip or fall that has been caused by an uneven, slippery or otherwise unsafe surface (be it a pavement, hard floor or carpet), you may be entitled to bring a claim for damages for your injury and your financial losses arising as a result of the injuries.

There are various laws in place to try to ensure that people are safe in walking around their whole environment. This will include walking along the pavement or crossing the road; When you are in a shop or other public place; At work; and can even be in somebody else’s private property.

Generally speaking there is responsibility to ensure that places where you are walking do not have any danger that is likely to trip you up, or cause you to slip and fall.

If this has happened to you the person responsible for the place where you fell may have failed in their duty to ensure that it is safe for you to be there and should have public liability insurance to cover such an incident.

How can Linder Myers LLP help?

If you have unfortunately suffered a fall and as a result, have injured yourself, it may not only be painful and inconvenient, but it could cause you to suffer significant financial loss, particularly if you are unable to work.

If you do not bring a claim, you may loose out financially, particularly in respect of loss of earnings if your employer does not provide you with a full salary for the time you are unable to work; or if you are self employed.

If you require physiotherapy or surgical treatment to help recover from your injury, this can also be claimed so that you can receive the treatment on a private basis, giving you the, quickest and most attentive care possible to help your swift recovery.

You are also entitled to damages for the pain and suffering you have gone through, which although might not make up for the inconvenience you have gone through, may go some way in cushioning the blow perhaps by allowing you to treat yourself afterwards.
