Redundancy for employers

When planning to make employees redundant it is important that a business follows the right procedure. Failure to do so can lead to significant awards of compensation not to mention the costs of representation and the wasted management time associated with defending such proceedings.

Employers need to carefully plan how the redundancy process is going to be managed from the outset with particular consideration being given to the following:

  • is there a true redundancy situation?
  • if so, which employees are affected by the redundancy situation and who should be included in a pool for selection for redundancies?
  • what criteria should be used for selecting employees for redundancy and is such criteria lawful?
  • is there a process in place for fair and objective application of such criteria and
  • are there any positions of alternative employment available to employees whose positions are threatened by redundancy?
