Neighbour disputes

Neighbour disputes can cover all manner of problems you can have with the people who live closest to you. This can include:

  • boundary disputes
  • problems with the behaviour of neighbours
  • overhanging trees or branches
  • tree roots that are causing damage

  • access to their property for repairs

These types of disputes are often very distressing for the parties involved, as they are constantly faced with the problem each time they are at home.

Boundary disputes

You should check the title deeds for your property, which should contain a plan for the measurements and parameters of the land that you own. A copy of the Title Deeds can be obtained from the Land Registry. You may wish to instruct a surveyor or Solicitor to interpret how these correspond with your property.

Noisy neighbours

There are several steps you can take to try and reduce noise created by your neighbours. These include reporting them to their landlord or to the Local Authority.

Problems with your neighbour's trees and tree roots

If your neighbour's tree or its branches are overhanging over your property, this is a form of trespass and you may be able to cut the tree/branches back to the boundary line of your land. However, you must ensure that there is no tree preservation order in place and that you get the tree owners permission before doing so.

It may be more serious if your neighbour's tree roots are encroaching onto your land and causing damage. Your neighbour may then be liable for the cost of putting right the damage caused. However, your neighbour must have known or ought to have known that the tree roots would cause damage.

Access to your neighbour's land

If you need to access your neighbour's land to repair part of your land or a shared amenity, there is usually a right of access specifically for the purposes of carrying out repairs stated in the Title Deeds to the property.

Party walls

If you want to carry out structural work to walls that stand across the boundary of your land and your neighbours land, then you must adhere to rules governed by the Party Wall etc Act 1996. These rules stipulate a set procedure that should be followed and you could be fined up to £1000 if you fail to comply.
