Motoring offences

We defend both individuals and businesses against prosecution for motoring defences.

Common prosecutions include:

  • Driving whilst using a mobile telephone
  • dangerous driving
  • speeding
  • breach of operators licenses (VOSA/Police)
  • overloading vehicles
  • drivers hours and tachograph rules

Some of these prosecutions can apply to both the driver and the company or individual instructing the driver where relevant. We also represent companies and individuals at Public Inquiries before the Traffic Commissioner.

Depending on the type of prosecution, there are a number of options available to you. Linder Myers Solicitors will advise you and strive to protect you and your company’s best interests where appropriate. We recognise that this can often be a stressful time and so work with you to ensure that the procedure is explained clearly to you throughout.

Our specialist team have a very successful record in defending against prosecution for motoring offences, and should be contacted in the first instance to ensure that we can advise and support you throughout every step of your case.

We offer advice in relation to:-

  • totting up and exceptional hardship arguments
  • special reasons
  • mandatory disqualification offences
  • “new drivers” legislation
  • “drunk in charge” offences
  • Failing to stop/report
  • Driving other than in accordance with a license
  • Alternative verdicts
  • Other offences
