Our experience
Our Regulatory department have expertise in dealing with matters such as this arising from Health and Safety executive/Local Authority Officers’ inspections. Should an inspection reveal breaches or potential breaches of Health and Safety Law, it will be of the utmost importance to protect you and your business. Our knowledge and experience in dealing with Enforcement Authorities means that you would be in the most capable hands managing any potential investigation.
All investigations into Health and Safety breaches are conducted in accordance with the Criminal Law, so specialist advice should be sought. Our solicitors will be able to present a case which will give you the best chance of avoiding any potentially serious prosecution.
Taking immediate action
We can advise immediately following any inspection whereby the authority intends to take action. We can advise you in relation to your internal investigation and by doing so keep the contents of your investigation report privileged from disclosure to the HSE/Local Authority.
We can assist you in determining whether the proposed action by the local authority such as a notice, is merited, accurate and achievable and if not advice as to how you may appeal that decision.
In the event of prosecution
If the authority chooses to prosecute you we can advise throughout, attending any interview under caution and advising you of any necessary preparation you must do prior to the interview and the information you must provide, if any, at the interview. By doing so we may hopefully influence the decision to prosecute you at all, or for what offence.
We can consider the allegations of breaches and determine whether any defence exists. We can then gather evidence to prepare and if necessary present a comprehensive case at any trial. Even if no defence exists, we have extensive experience in advising clients as to how to minimise the effect of a conviction by way of mitigation and presenting this to any court.
