Health and Safety Law

As an owner of a B&B/Hostel or Hotel with 3 or more rooms, you will understand that you have duties under Health and safety Law to both your employees and to members of the public. The basis of British health and safety law is the Health and Safety at Work etc Act 1974.

What the law requires is what good management and common sense would lead you to do anyway: that is, to look at what the risks are and take sensible measures to tackle them.
 

Q: Who enforces the law?

Health and safety considerations are wide-ranging as the legislation, guidance and best practice is vast.

The Health and Safety Executive (HSE) are the main regulatory body who enforce Health and Safety Law and were they to visit your premises they would no doubt find something wrong, whether it be a loose carpet or slipping risks outside. This is the nature of health and safety. It is there to protect people.

For the examples given above the HSE would give some informal advice as to how to rectify them and that would be the end of it. We aim to give you some insight as to what considerations you must have in relation to health and safety so as to ensure that you don’t run into problems with the HSE or Local Authority over more serious matters.

Q: What happens if there is an accident?

In the instance of any injury to your guests or employees the authorities will undoubtedly carry out an investigation into your bed and breakfast/hostel/hotel. If the danger could have been avoided by your consideration of the things listed above it may prompt the Health and Safety Executive (HSE) or Local Authority to take formal action.
