Fire safety
The Regulatory Reform (fire safety) Order 2005 was introduced in October 2006 and makes certain individuals responsible for taking steps to protect the people using their premises from the risk of fire.
If anyone pays to stay in your property then the law applies to you.
If you are the “responsible person” i.e. the person who has control of the premises or the owner then Linder Myers can assist in you implementing the measures prescribed in the Act.
Are you aware of your fire safety obligations?
You are legally obliged to carry out a fire risk assessment of your premises, implement improved safety measures and keep potential fire risks under review. You ought to keep a record of these risk assessments and reviews and produce a plan to ensure you are compliant with the Order and to ensure certain areas of the premises are kept under observation.
The risk of non compliance can seriously affect your business.
Of course the safety of your customers is paramount and if this is deemed to be inadequate then this may affect your star rating. In such a competitive market maintaining your star rating is imperative for a successful, money making business.
The enforcing Authority (most likely the local fire service) has the power to inspect your property and ensure you are compliant with the Order. If the Authority is unhappy it can issue: an Enforcement Notice - which stipulates certain improvements or a Prohibition Notice - which can restrict the use of part or all of your premises until these improvements are made.
Failure to comply with your duties or the Order is an offence which at its most serious can lead to a conviction and imprisonment and / or a fine.
