Court of Protection and assurance visits

Once you have been appointed as deputy by the Court of Protection, as part of the Court overseeing the deputyship they may ask one of the Court of Protection visitors to meet with you for an assurance visit. Following a visit the visitor will always prepare a report of their findings.

Recently the Court have issued a practise note which gives a bit more information about Court of Protection Visitors and what their role is. In short there is a panel of visitors, some are called special visitors and are medically qualified, and others are general visitors who are not medically qualified but have experience of mental incapacity.

The purpose of the visit could be part of the ongoing supervision of the deputyship or could be to look at a certain issue. Usually the deputy along with the incapacitated person is interviewed to see how things are going.

Following the visit it is most likely you will want to see a copy of the report. Generally if you have been interviewed by the visitor allowing them to prepare their report you will be provided with a copy however if you haven’t you can request a copy from the Office of the Public Guardian. The report will give an indication of what is going right and where there may be room for improvement.
