The law in relation to commercial agents is complex. In many respects commercial agents have greater protection than employees. Unlike in an Employment Tribunal there is no maximum amount that a commercial agent can be awarded if they have a successful claim arising from the termination of their agency. Awards of compensation can run into hundreds of thousands of pounds.

Many organisations are unaware of the application of Commercial Agents Regulations and the potentially high costs of compensation. However, businesses can limit their exposure to claims by having a property drafted commercial agency agreement.
