DNA/Fingerprints Deletion

In 2008, the European Court of Human Rights unanimously ruled that the domestic law to indefinitely retain the fingerprints and DNA of innocent people is a breach of a person’s human rights. The Court held that the “blanket and indiscriminate retention” was not necessary in a democratic society and breached their right to a private and family life.

Whilst the law still stands, police constabularies are now less reluctant to retain fingerprints and DNA of innocent people due to the threat of legal action following the judgment of the European Court. Recently there have been a series of successful requests for deletion by the Greater Manchester Police following a simple request in writing.
