Andrew Cusworth | Partner

Andrew joined Linder Myers in March 2004 as a Partner in the Trusts and Estates department. He is based at the Manchester office but co-ordinates the department across our regional offices.

Andrew specialises in:

  • estate planning using Wills, trusts and lifetime giving
  • probate and the administration of estates
  • tax planning
  • trust administration
  • Court of Protection
  • issues affecting the elderly

Andrew holds a large number of appointments as executor, trustee, attorney and deputy. In addition he acts as litigation friend for individuals with impaired mental capacity. He is also a trustee of a number of charitable trusts. Andrew has acted as executor in several estates where, following dispute, he has been appointed by the Court as an independent replacement for a previous executor.

Andrew has particular experience of estate planning and tax planning using wills trusts and lifetime giving, including dealing with high net worth estates, businesses, farms, overseas assets, difficult family circumstances and issues of domicile. He deals with complex estates.

Andrew also leads the Court of Protection arm of the trusts and estates department, which specialises solely in issues concerning capacity, powers of attorney, Court of Protection, personal injury trusts, advanced medical decisions, preserving assets in the event of long term residential or nursing care and advice on financial responsibility and funding for long term care including NHS funding care. He acts as Court of Protection deputy for a large number of clients including those with acquired brain injury, injury as a result of clinical negligence, psychological injury and PTSD as well as clients suffering from dementia and other similar illnesses. He acts as deputy for clients during the litigation and claims to the Criminal Injuries Compensation Authority. He supports the litigation team and acts as a witness for the deputyship claims, as well as acting as litigation friend in a number of cases.

Andrew also acts as trustee for a large number of personal injury trusts. He has been approached in a number of matters as an independent person to act as litigation friend for respondents with impaired mental capacity on an application by a relative for the preparation of a statutory will.

Andrew regularly presents seminars on issues relating to trusts and estates. He also provides training to a number of organisations.

Andrew is married with children. Aside from his family, his main interest is sport. He coaches junior football and follows Manchester City home and away.

Panel appointments: Andrew is appointed to the Office of the Public Guardian panel of professional Deputies. The appointment means that the Court of Protection may now call upon Andrew to act as an independent Deputy for an incapacitated person.
