Alcohol
The Licensing Act 2003 changed much of the established practices and procedures many enterprises had been used to. There is now the requirement of two forms of license for the provision of alcohol.
The new legislation requires that you obtain the following otherwise you will be committing an offence:
- a Premises Licence (the premises must be suitable for use for licensable activities)
- a Club Premises Certificate (the replacement for club registrations) or a Temporary Event Notice (the replacement for Occasional Licences).
A Personal Licence must also be obtained before any person can supply alcohol or authorise its supply. So at the very least you need to have in place one person (more is strongly advisable) at the premises who holds a Personal Licence.
Without question, the biggest concern clients have in this area is the possibility of selling alcohol to someone under age. The penalties for both the Premises Licence Holder and the person who sold the alcohol to a child can be severe. We advise our clients to be on their guard and to develop robust policies that address this issue. We can be of assistance to you in this regard.
