Accidents in public places

Slipping or tripping accidents, falls or any other injury suffered in a public place are unfortunately a common occurrence.

A public place is just that, and can be anywhere where you are allowed to go without requiring special permission such as a shop, library, supermarket, shopping centre, bank, leisure centre, bar, restaurant, pub, or on a car park, road, or pavement.

The person responsible for that particular place have a duty to ensure that it is reasonably safe for you to be there. Accordingly they must ensure that any dangers in that place such as dangerous or unsafe items of furniture or equipment, trip hazards, slippery floors, or anything else that is likely to cause injury due to its location and presence on the property, must be checked-for, maintained and repaired to ensure that any risk to the public is minimised.

Where these duties have not been fulfilled, and somebody has suffered personal injury, then the injured person may be able to bring a claim for compensation in respect of the injury they have suffered and any financial losses (such as loss of earnings, cost of any medical treatment, and cost of replacement clothing, etc) that they have suffered as a result of the accident.

Anybody who has been involved in an accident of this type can bring a claim for compensation from the person responsible for the public place who, in most cases, should have Public Liability insurance to cover such incident.

Ask for a copy of the report. If they don’t give you a copy of the report, to make a note of the name of the person you are reporting it to, and if there is any reference or report number that they can give you. You should also take photographs of the scene of the accident, showing the defect that caused your accident, preferably with some indication of the scale. (if you do not have a ruler available, placing credit card or other familiar object next to the defect will give a useful indication of it’s size).
